OffPeak — Terms of Use
OffPeak is the merchant directory inside the OffDuty app: businesses publish their quiet hours, and people who work shifts find them. These terms cover both sides of that — using the directory, and being listed in it.

1. What OffPeak is
OffPeak is a directory. Businesses publish their quiet hours and their offers; people who work shifts — the users of the OffDuty app — find them at times that suit both sides. We operate the directory. We do not operate the businesses in it, we are not a party to what you agree with them, and we take no commission on anything you buy from them.
2. For people using OffDuty
Your schedule is never shared.Matching your free time against a merchant’s availability happens on your own device. The merchant’s open hours come down to your phone; your calendar does not go up. A business cannot see when you work, when you are off, or what else is in your diary — before a booking, during one, or after.
Nothing reaches a merchant until you send it. Every appointment starts with you: you pick the time, you fill in the form, you press send. At that moment the merchant receives exactly what you typed — a name, one way to contact you, the slot, and any note you added — and nothing else. Browsing a listing, saving one, or adding an offer to a plan tells the merchant nothing at all.
We do not sell or share your personal data with merchants for marketing. There is no list a business can buy, no audience they can target, and no way for one to contact you unless you contacted them first.
Listings are written by the businesses themselves. We check what we reasonably can and we screen uploaded images automatically, but we cannot verify every claim, price or qualification. Treat a listing the way you would treat any advertisement: share personal details carefully, and never send payment or card details through a chat. Every listing has a Report button, and a person reads every report.
3. What you agree to as a merchant
Publishing a listing means accepting these terms. The people reading it are shift workers — nurses, cabin crew, hotel and security staff — looking at their phones between shifts, and the standard below exists so that the directory stays somewhere they are willing to look.
- Everything you publish must be accurate, lawful and yours. Your description, prices, photos, offers and opening hours. Do not advertise a service you are not licensed or qualified to provide.
- Nothing offensive, and nothing adult. No sexual or suggestive content, no nudity, no violence or gore, no hate speech, no harassment, no content that demeans people by race, religion, sex, gender, sexuality, disability or age, and nothing promoting illegal activity. Your listing appears in a general-audience app with no age gate; assume anyone can see it. Images are screened automatically when you publish, and screening is not approval — the responsibility for what you upload stays yours.
- Treat customers with respect. Serve OffDuty users on the same terms as anybody else, and do not refuse, mistreat or price differently on the basis of race, religion, sex, gender, sexuality, disability, age, or the job they do. Rudeness, pressure selling and harassment in enquiry messages are breaches of these terms, not style differences.
- Honour what you published. A booking you confirmed, and an offer as you wrote it. If you cannot, say so through the portal — do not let a customer arrive and find out.
- Contact details are for that booking. Do not add a customer to a marketing list, sell their details, or pass them on. Never ask for payment card details, identity documents, or a deposit through the enquiry chat.
- One listing per business, advertising that business. Listings that exist to promote something else will be removed.
4. Listing fees
A published listing may require a paid subscription. The price, the currency and the billing period are shown before you subscribe and at checkout; that is the amount charged. Subscriptions renew each period until cancelled, and you can cancel at any time from the billing portal — your listing stays up until the end of the period you have paid for. Fees already paid are not refunded on cancellation. If we change the price, existing subscribers are told before it takes effect.
If we remove your listing or an offer because you broke section 3, the fee for that period is not refunded. The subscription pays for a listing that meets the standard above; a listing withdrawn for breaking it has not been unfairly cut short, and refunding it would put the cost of enforcing the rules on the merchants who follow them. This applies to removal for a breach only. If we withdraw your listing for any other reason — we close the market, we change the product, we made a mistake — we refund the unused part of the period.
5. Sample listings
While the directory is new it contains a small number of example listings written by us, so that both merchants and users can see what a listing looks like. They are labelled [Sample] in the app, they take no bookings, and they are ranked below every real business. They are removed as the directory fills.
6. Our right to take a listing or an offer down
We may remove any offer, image, description or whole listing that breaks these terms, at our discretion and without notice. We may also suspend the account behind it. We will normally tell you what was removed and why, and give you the chance to fix it and republish — but where content is offensive, unsafe, or being reported by users we will take it down first and explain afterwards.
We may also remove a listing that is reported and found to be misleading, that impersonates another business, or that we are legally required to remove. Removal for a breach does not refund that period’s fee — see section 4.
You can unpublish or delete your own listing at any time from the portal, and that is always available to you before it comes to any of the above.
7. Liability
The directory is provided as it is. We do not warrant that a merchant will be available, that a service will meet your expectations, or that a listing is accurate. Any agreement about a service is between you and the merchant. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
8. Changes and contact
We will update these terms as OffPeak changes, and the date at the top will say when. Continuing to use OffPeak after a change means accepting the updated terms. Questions, reports and complaints: support@rosterarchitect.com.
